Draft legislation recently released by the Australian Government reveals higher penalties for serious or repeated breaches of Australian privacy laws. Under the draft Privacy Legislation Amendment ( Enhancing Online Privacy and other Measures) Bills 2021 the maximum penalty of $2.1 million for serious or repeated breaches of privacy will increase to the greater of $10 million, or three times the value of any benefit obtained through the misuse of information, or 10 per cent of the entity’s annual Australian turnover. The proposed legislation provides a timely reminder for all organisations to review their privacy management frameworks to ensure staff have proper guidance on the policies and procedures that promote good privacy practices and that systems are in place to prevent misuse of personal and sensitive information.
